Foreign Will

On the death of a Dutch national or someone who is domiciled in the Netherlands, it should not be assumed that his or her estate will be settled entirely according to Dutch law. If this person has any property in another country, it is possible that this property will be subject to the law of the country concerned. This can also be the case if the deceased held Dutch nationality but lived abroad or was a foreign national living in the Netherlands. To determine whether property falls under any other jurisdiction at the time of death, we must consult private international law.

 

Where any international aspects apply, it can be prudent or even essential to make separate Wills in the relevant countries, since the Will you have made in the Netherlands may not apply elsewhere.
